1. Notarization, Authentication & Legalization
The main difference lies in the intended use of the document and its legal effect:
Notarization
The notary public personally witnesses a legal act or private right fact and issues a notarial certificate — the strongest form of proof. Certain legal acts may even include a clause allowing direct compulsory enforcement without further litigation.
Authentication
The notary public verifies the authenticity of a signature, that a copy matches the original, or that a translation matches the original text — commonly used for powers of attorney, contracts, diplomas, and translated documents.
Legalization
For documents to be used abroad, after notarization or authentication, further verification by Taiwan's Bureau of Consular Affairs (MOFA) or an overseas mission is usually required. Requirements vary by country and receiving authority — please confirm with the institution requesting the document; our office can also assist.
2. Notarization Overview
A Notary Public witnesses a legal act or private right fact and creates a notarial certificate to prove its creation or existence.
Subjects of Notarization:
- Legal Acts: Execution or revocation of contracts such as sales, leases, gifts, etc.
- Private Right Facts: Facts of possession, web page content, parental rights facts, etc.
※ The Notary Public must personally witness the legal act or fact to create the notarial certificate.
3. Authentication Overview
Authentication mainly involves verifying the authenticity of signatures on private documents, certifying that a copy matches the original, or certifying that a translation matches the original text.
